Website - Terms and Conditions

Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the https://sertified.me website or purchasing a Sertified., LLC Service (the “Service”). This website and Sertified., LLC classes are operated by Sertified., LLC (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who wish to access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you do not have permission to access the Service.

 Refund/Failure Policy

  • The only instance in which an individual will receive a refund is if they notify Sertified. of their need for removal from the course, at least 72 hours prior to the start time of the course. This request must be submitted, via email, to admin@sertified.me. All requests for removal from a course, after 72 hours prior to the start of the class, will not be considered. Please carefully note: No extenuating circumstances will be considered for refund, after 72 hours prior to the start of the class! Transferring to a future class will require the payment of an additional course fee. 
  • If the participant is unable to and/or fails to complete the online coursework, in its entirety, prior to the start of the class, he/she/they will NOT be refunded any portion of the course fee. Transferring to a future class will require the payment of an additional course fee.
  • If the participant does not attend/is unable to attend the in-person skill session, in its entirety, he/she/they will NOT be refunded any portion of the course fee. Transferring to a future class will require the payment of an additional course fee. Note: Participants/Candidates who are late to any class session will not be admitted.
  • If the participant is unable to successfully complete any one of the requirements for certification, during the in-person skills session, he/she/they will NOT be refunded any portion of the course fee. Transferring to a future class will require the payment of an additional course fee.
  • Aquatic-Based Courses: If the participant is unable to successfully complete any one of the requirements during the in-water prerequisite skills session, he/she/they will NOT be refunded any portion of the course fee. Transferring to a future class will require the payment of an additional course fee.
  • Aquatic-Based Courses: If the participant successfully completes the requirements of the in-water prerequisite skills session but is unable to successfully fulfill the requirements for completion of the American Red Cross Lifeguarding class, he/she/they will NOT be refunded any portion of the course fee. Transferring to a future class will require the payment of an additional course fee.
  • In the case of a weather-related, or other pertinent issues, the course will be moved to an alternate location or rescheduled. If the student is unable to attend at the given location, at the given time, he/she/they will NOT be refunded any portion of the course fee. Transferring to a future class will require the payment of an additional course fee.
  • Instructors reserve the right to refuse a participant to continue in a class, if he/she/they does/do not believe that the student will successfully complete the class. The instructors also reserve the right to terminate any student who is causing disruption or is acting inappropriately in the course. Any of these instances (or other potentially similar instances) will not result in a refund. Transferring to a future class will require the payment of an additional course fee.

Use of Company Equipment: 

In order to maximize the effectiveness of our trainings, Sertified., LLC agrees to allow you (the participant/candidate) to use the necessary course materials, equipment, and supplies, as outlined in the course’s American Red Cross Instructor’s Manual and/or Instructor Trainer Guide. In return, Sertified., LLC expects that all equipment will be returned in the same condition as when it was lent to you. In order to receive certification, you must return all borrowed equipment back to the course instructor, in the condition that it was lent. Failure to comply with this regulation will result in the withholding of certification, until the equipment is either replaced or repurchased, at the expense of the student. Pending successful completion of the class, once the lost, damaged, destroyed, and/or stolen equipment is replaced or repurchased (by the student) and received by Sertified., LLC Administrators, certification will then be issued. 

You agree to inspect equipment prior to use and notify the instructor if there is any pre-existing damage. You agree to thoroughly disinfect and return all items, promptly, to the course instructor by the end of the course. You understand that you are responsible for replacement costs if the equipment is lost, damaged, destroyed, or stolen. If you fail to return the materials in reasonable condition to the course instructor, you understand that you will not be issued a certification until the materials, equipment, and/or supplies are replenished. 

Accommodations Request: 

All requests for accommodations must be in compliance with the Americans with Disabilities Act. Should you need to request accommodations, please do so by filling out the ‘Request for Accommodations’ section on the course registration page, prior to submitting payment. If you are unable to disclose this information via the request form, please contact Sertified.’s Administrative Office for further instruction. 

Release and Use of Photo/Video Content

You grant permission to Sertified., LLC. and its agents and employees/contractors the irrevocable and unrestricted right to reproduce the photographs and/or video images taken of you (the customer), or members of your family, for the purpose of publication, promotion, illustration, advertising, or trade, in any manner or in any medium. By agreeing to these terms, you hereby release Sertified., LLC. and its legal representatives for all claims and liability relating to said images or video. Furthermore, you grant permission to use statements that were given during an interview or guest lecture, with or without your name, for the purpose of advertising and publicity without restriction. You waive your right to any compensation.

Use of Customer Information

By agreeing to these terms and conditions, you agree to allow Sertified., LLC to release your name, email address, and phone number to partnered agencies. You grant Sertified. the unrestricted permission to contact you, regarding recruitment for employment either with Sertified., LLC or with partnered agencies, associations, universities, colleges, etc. If you wish that your information not be shared or released or used for contacting you for future employment opportunities, you must contact Sertified., directly, to opt out.

Waiver and COVID-19 Waiver

PLEASE READ, CAREFULLY, BEFORE SIGNING. THIS IS A RELEASE OF ALL LIABILITY AND WAIVER OF CERTAIN LEGAL RIGHTS.

 

I, , the enrolled participant/candidate and/or the parent/guardian (if participant is under the age of 18) of the participant/candidate agree and understand that the activities at hand are potentially HAZARDOUS and DEMONSTRATIVE activities. I recognize that there are risks inherent in the practice of these skills, including but not limited to, paralyzing injuries and death. These trainings will also involve skin-to-skin, physical contact between students and instructors. Neither students nor instructors will be held liable for any injuries, illnesses (including, but not limited to COVID-19),  misunderstandings or accusations. The participant/candidate and/or parent/guardian hereby agrees to participate in the American Red Cross certification class, and hereby agrees to indemnify and hold harmless all instructors, supporting personnel, and the hosting facility and their staff against any liability resulting from any injury that may occur to the participant/candidate while participating in the class. The participant/candidate and/or parent/guardian also agrees to indemnify all instructors, support personnel (e.g., lifeguards, co-instructors, etc.) and the hosting facility and their staff for any damages incurred arising from any claims, demand, action or cause of action by the participant/candidate. 

 

The participant/candidate and/or parent/guardian authorizes all instructors, trained support personnel, and the hosting facility and their staff to have the participant treated in any medical emergency during their participation in the class. Further, the participant/candidate and/or guardian agrees to pay all costs associated with medical care and transportation for the participant. I have also made the course instructor aware, in writing, in the Course Notes section of the registration information, of any medical/health problems of which he/she/they should be aware. 

 

I have carefully read the above liability release and signed it with full knowledge and understanding of its contents and significance.
